Sumario:This article seeks to account for the relationship that exists between the scarce application of the figure of social damage and the Costa Rican criminal policy. It is through their characterizations, starting from the real objective conception where they are understood as two complex phenomena. Hence, an attempt was made to answer the question: what place does social harm have in the country’s criminal policy? This is in the context of the theory of damages, and of possible effects on the collectivity and social welfare.
