Résumé:This article deals with the events surrounding both, the non re-election and the reelectionof the constitutional judge Fernando Cruz Castro, on November 2012. The eventwas treated as an unprecedented and unique situation. However, in this article it is seenas a conspicuous expression of our institutional order and our political system, which havebeen shaped during the last thirty years, throughout the market opening process. At thesame time, it can be taken as an additional window through which we can observe the erosionof the separation of powers established in the Constitution of 1949.
